Early collection of bank credit does not occur automatically


According to SCC starting point of chargeability making a consumer loan agreement, the arrangements for the occurrence of premature claim for non-payment of certain contributions may not occur if the application for issuance of a writ of execution creditor has notified the debtor to declare prematurely claim the credit.
In the absence of evidence of valid done statement from the bank or a subsequent transferee, announced the debtor before the commencement of the order production that considers the loan to be repaid early, it could be assumed that the creditor has duly exercised his right to request compulsory implementation of outstanding receivables. References to the early collection deposited in the court application for an enforcement order in chl.410 CPC for all arrears, it could mean that there is a proper message to the debtor and that there is a call for payment.
